Jay Ploue provided a brief history of the Marigny Trace Property Owners Association [MTPOA], including original members of Architectural Control Committee: Jay Ploue, Buddy Coate, & Ellen, secretary to Jay Ploue.
Charles Leche presented developers with meeting objective, to seek transfer of MTPOA to residents of Marigny Trace, including review of applicable by-laws & covenants. The developers advised they were both comfortable turning over the MTPOA permanently to the Marigny Trace residents, leaving only the Architectural Control Committee with them, & agreed to the addition of 2 members from the residents of Marigny Trace to “police” the neighborhood & enforce the by-laws & covenants.
Buddy Coate presented the possibility of a future phase to Marigny Trace south of Bayou Castine.
Discussion was held establishing desire of developers to retain control of Architectural Control Committee [ACC] as to new construction only & to interface with builders; with MTPOA to enforce by-laws & covenants as to all other architectural issues; including expansion of ACC to not more than 5 members, with 3 being appointed by developers.
A review of the by-laws & covenants took place as to majority representation of residents (51%) needed to ratify changes.
The formal transfer was proposed for final vote at the April 14, 2007 MTPOA General Meeting, with notice & proxy ballots to be distributed to all Marigny Trace residents prior to that meeting.
Assurance was made by Jay Ploue to resolve water retention issue on Tanager Dr. at Lots 161, 148 & 149.
A brief discussion was also held with Jay Ploue as to forthcoming development of Lots 157 & 159.
Goals & Objectives:
1. Finalize transfer of MTPOA to residents, including transfer documents provided by Paul Mayronne, Esq., attorney for developer(s), to Charles Leche, Esq., MTPOA parliamentarian, including vote procedure by Marigny Trace residents.
2. Transfer documents to be completed by March 15, 2007 to allow for distribution to residents along with proxy ballots in advance of April 14, 2007 MTPOA General Meeting.
3. Transfer MTPOA bank account from developers to MTPOA treasurer, to be coordinated between Buddy Coate, developer, & Don Vekic, MTPOA Interim Treasurer.
4. Establish interim MTPOA Board of Directors, including notification & vote procedure by Marigny Trace residents.
5. Establish protocol for enforcement of MTPOA by-laws & covenants, & publish / deliver to all Marigny Trace residents.
