Dear President Davis:

Please accept the sincere appreciation of the Marigny Trace Property Owners Association ("MTPOA") for your time in meeting with us this morning (May 19, 2008) on the street construction and Performance Obligation issues of Marigny Trace Phases 6A & 6B. The following will briefly summarize the results of the meeting.

Keith Macaluso - Resident, Lot 156, Marigny Trace

The representatives of MTPOA indicated that they were concerned with the ongoing failure of the developers (A) to correct the construction of the "cutback" (or "kneecap") in Tanager Drive in Marigny Trace Phase 6B, and (B) to complete the items set out in a "Performance Obligation" relating to drainage in Marigny Trace Phase 6A.

Concerning issue "A," the Tanager Drive "kneecap:" Following the presentation of the original Parish-approved plan for Phase 6B, the "as built" plat showing the actual construction of Tanager Drive in Phase 6B, and general discussion, President Davis indicated that the developers will be required to re-construct the Tanager Drive "kneecap" to conform with the originally-approved plat plan, File No. 3587 dated 10/11/2004. President Davis indicated that the developers would be placed on notice as soon as possible that they must make the street conform to the original approved plan, and that a short deadline would be set for their compliance.

Concerning issue "B," the long outstanding drainage issues of Phase 6A were also discussed, including the issue of resident fences having been erected on Parish drainage servitudes, as well as the issue of silt abatement. It was brought to the attention of President Davis and CAO Oiler that Parish assumption of responsibility for the drainage canals and streets in Phase 6A is contingent upon (a) clearing the drainage servitudes of obstructions (improperly placed fences) and (b) the developers meeting the other requirements of the performance obligation, which is set to expire in August, 2008, after many extensions. President Davis indicated that the Parish would require the developers to do the necessary work to clear the servitudes and complete the remaining requirements of the performance obligation.

President Davis instructed Executive Counsel Rabalais to initiate notification to the developers (Jay Ploue & Buddy Coate / Marigny Trace Development), to enforce the necessary work on issues "A" and "B" in a timely fashion.

President Davis gave assurance that all efforts will be made to resolve the outstanding street and performance obligation issues as quickly as possible, in which CAO Oiler concurred.
